LEGAL NOTICE
IN THE MATTER OF THE
SINGLE COUNTY DITCH #1330
PETITIONED FOR BY PROPERTY OWNERS WITHIN
O.B. FRAILS SUBDIVISION
TO THE OWNERS OF THE LAND
AFFECTED BY THE PROPOSED IMPROVEMENT

 YOU, and Each of You, are hereby notified that on the 24th day of October, 2017, the above named petitioner filed a petition to reconstruct, clean and maintain an existing drainage system on the proposed course hereinafter set forth.

The following is the legal description of the beginning, route, and end of the proposed project:

Commencing on the west side of South Dixie Highway and south side of West Breese Road, T4S, R 6 E, in the NW Corner of Section 23 of Shawnee Township, Allen County, Ohio.  Thence, through the Frail Subdivision in a westerly direction with several storm sewers/ waterways to an open ditch between the O. B. Frail’s Subdivision and Spyker/ Bunke Subdivisions. Thence, westerly and northerly under Breese Road and terminating at Reed Road.  The project shall also include an open ditch commencing 520 feet west of Poinsettia Drive at an existing roadway culvert, thence southwesterly direction to its confluence with the main open ditch west of Joyce Lane.

The primary storm sewer system was installed when the O.B. Frail’s Subdivision was platted in the 1950’s and Spyker Subdivision, platted in the 1980’s.  Portions of this project were previously petitioned as Clarence Stewart #662 in 1924, H. A. Sloneker #746 in 1929, and McMillen #963 in 1954.  These are not on county maintenance.  The Laratta #1149 adjacent to the south side of the O. B. Frail’s Subdivision was constructed in 19991 and is county maintained.

Because it is claimed that your property will be benefited by the proposed improvement, either directly by having a part of it on your property, or indirectly by having stormwater runoff from your property drain through it.  If the Board of County Commissioners, after viewing the proposed course and conducting a public hearing, approves the project, your property would be assessed for your portion of the costs of engineering, construction and future maintenance.

You are further notified that the Board of County Commissioners of Allen County has fixed the following date, time, and place for the view and first hearing on the proposed improvement:
